General Terms and Conditions

The General Terms and Conditions of Service ("GTC") contain the general terms and conditions for the use of the webshop operated by Kelvin Klíma Kft. (registered office: 2440 Százhalombatta, Honfoglalás u. 33. tax number: 12807017-2-13) as a service provider ("Service Provider"). Please use our services only if you agree with all of its points and consider yourself bound by them. This document is not filed, is concluded in electronic form only (it does not constitute a written contract) and does not refer to a code of conduct.

Basic provisions

1.1 Hungarian law shall govern the issues not regulated in these Rules and the interpretation of these Rules, in particular with regard to the relevant provisions of Act V of 2013 on the Civil Code for Fulfillment Services for Webshops ("Civil Code") and Act CVIII of 2001 on certain issues of electronic commerce services and information society services. The binding provisions of the relevant legislation shall apply to the parties without any specific stipulation.

Available products and services: trade of VW engine parts and accessories, rebuilding and installation of complete engines.

1.6 The products displayed can be purchased online or in person. Do the products include VAT and packaging charges? Not all products include delivery charges.

1.7. In the webshop, the Service Provider shall display the name and description of the product in detail, and shall display a photo of the product. The images displayed on the product data sheets may differ from the real ones, in some cases they are used as illustrations.

1.8 If a promotional price is introduced, the Service Provider shall fully inform Users about the duration of the promotion.

Ordering procedure

1.9. You can click on the "Add to Cart" button next to the product photo to select the product you wish to purchase, continue shopping, or click on the "Add to Cart" button to continue your order. Here you can check the details of the product you have ordered and then proceed to checkout by clicking on the "Proceed to checkout" button. After entering your billing and shipping details, you can select your payment and delivery method. You can finalise your order by clicking on the "Order" button, thereby accepting the General Terms and Conditions.

1.10. Options for correcting data entry errors:We will send you a confirmation of your order, where you can check the products you have selected and the data you have entered. If you find an error (wrong product or incorrect delivery billing details), please send a clarification email to our email address ( kelvinklimakft@gmail.com). (either to cancel an order or change data)

1.11. Payment options, delivery methods: Payment can be made on the spot in cash, by bank transfer or by cash on delivery. Larger or heavy products (complete engines, complete engine blocks) are delivered free of charge in Hungary with our own car.

1.11.2 Prices: prices indicated in the shop include VAT. All prices are inclusive of VAT. However, even with the greatest care, it is possible that, due to a technical error by the Service Provider, an incorrect price may appear on the interface used, which is significantly different from the market price. In such a case, the Service Provider will contact the Customer by telephone (or e-mail) before the delivery of the goods to confirm whether the Customer wishes to purchase the Device at the real price. Such orders shall not be considered valid and the Service Provider shall not be liable for any resulting damages.

1.12. The service provider's webshop is obliged to confirm the receipt of the user's order to the user by electronic means without delay. If this confirmation has not been received by the user within a reasonable period of time, depending on the nature of the service, but not later than 48 hours after the sending of the user's order, the user shall be released from the obligation to make an offer or contractual obligation. The parties may derogate from the above rules if they have so agreed.

Processing and fulfilling orders

1.13. Orders will be processed within 48 hours of receipt of the order.

1.14. General deadline for performance, within 5 working days of confirmation.

If the Service Provider and the User have not agreed on the time of performance, the Service Provider shall be obliged to perform the contract within the time or date specified in the User's request, or in the absence of a request, within thirty days of the receipt of the order by the Service Provider at the latest.

1.15. If the Service Provider fails to fulfil its contractual obligations because the product specified in the contract is not available, it shall immediately inform the User thereof and refund the amount paid by the User without delay, but no later than within thirty days. The fulfilment of this obligation shall not relieve the Service Provider of any other consequences of its breach of contract.

Right of withdrawal

1.16. Under the provisions of Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses, the User may withdraw from the contract within 14 days of receipt of the ordered product without giving any reason, and return the ordered product.

1.17. Procedure for exercising the right of withdrawal:The buyer may withdraw from the purchase without giving any reason, unless the part has been installed and removed or has been damaged for any reason. The supplier will refund the price of the product without delay, but within 14 days at the latest,

Guarantee, warranty

1.18. Our products are guaranteed for 12 months. In the event of a breakdown, you will be informed of the action to be taken by contacting the Service Provider in person or by telephone, or you can also contact us at one of our contact details. See also:

1.19. Complaints can be made via the contact details of the webshop

Miscellaneous provisions

1.20. Service Provider and User shall try to settle their disputes amicably. The User and the Service Provider stipulate the jurisdiction of the Pest County Court/Tribunal for any disputes within the scope of these Terms and Conditions that cannot be settled by agreement within 30 (thirty) calendar days.
